Terms and Conditions

This Digital Banking Terms and Conditions Agreement (“Agreement” or “Terms and Conditions”) between you and Provident Bank governs the use of Provident Bank’s Digital Banking Services (“Digital Banking”), inclusive of ProvidentConnect Online Banking (via the Internet or Microsoft¨ Money, Quicken¨ or QuickBooks), Provident Bank Bill Pay, Electronic Statements, Text (SMS) Message Banking, Mobile Banking, External Transfers, External Loan Pay, Zelle®, and Debit Rewards. This Agreement is intended to describe the general terms and conditions applicable to Digital Banking, as well as those terms and conditions specifically applicable to certain ancillary services individually available under our Digital Banking Services. The Terms and Conditions generally applicable to Digital Banking can be found below. The Terms and Conditions for each Service collectively herein referred to herein as “Digital Banking Services” can be found as follows:

WHEN YOU ENROLL AND/OR USE DIGITAL BANKING, YOU AGREE TO THE TERMS AND CONDITIONS OF THIS ENTIRE AGREEMENT (INCLUDING ALL ADDENDUMS) AND TO THE TERMS AND CONDITIONS OF PROVIDENT BANK’S CONSUMER DEPOSIT ACCOUNT TERMS AND CONDITIONS AGREEMENT, AS MAY BE AMENDED FROM TIME-TO-TIME. TO THE EXTENT THAT THERE IS A CONFLICT BETWEEN THIS AGREEMENT AND PROVIDENT BANK’S CONSUMER DEPOSIT ACCOUNT TERMS AND CONDITIONS AGREEMENT, THE TERMS OF PROVIDENT BANK’S CONSUMER DEPOSIT ACCOUNT TERMS AND CONDITIONS AGREEMENT SHALL CONTROL.

Please read this Provident Bank Digital Banking Terms and Conditions Agreement for the Digital Banking Services before tapping the “Complete Sign-up” button, and retain a copy for your records.

DEFINITIONS: Capitalized terms used throughout this Agreement and these Addendums are defined in Appendix A – Definitions. We suggest that you read these definitions prior to reviewing and/or accepting this Agreement.

A. ELIGIBILITY AND USER PROFILE

To enroll, use and/or participate in any of Provident Bank’s Digital Banking Services, you represent that you are a consumer who is 18 years of age or older and has an eligible personal checking or personal savings account, or a loan account used for consumer and/or household purposes at Provident Bank.

When you enroll, use and/or participate in any of Provident Bank’s Digital Banking Services or when you permit others to whom you have delegated to act on your behalf to use or access the Services, you agree to the terms and conditions of this Agreement. You represent that you have the authority to conduct transactions on your eligible Account(s).

You agree that you will not use the Transfer Service to send money to anyone to whom you are obligated for tax payments, payments made pursuant to court orders (including court-ordered amounts for alimony or child support), fines, payments to loan sharks, gambling debts or payments otherwise prohibited by law, and you agree that you will not use the Transfer Service to request money from anyone for any such payments.

Provident’s Digital Banking is intended for personal, not business or commercial use. You agree that you will not use the Service to send or receive payments in connection with your business or commercial enterprise. We reserve the right to decline your enrollment if we believe that you are enrolling to use the Digital Banking with your business account or to receive business or commercial payments. We further reserve the right to suspend or terminate your use of Digital Banking if we believe that you are using it for business or commercial purposes, or for any unlawful purpose.

We reserve the right to amend these Eligibility and User Profile requirements for use of Digital Banking. We will send you notice of such changes in accordance with your User preferences (i.e. e-mail, push notification). In some instances your express acknowledgment of continued eligibility maybe required. If so, we will instruct you as to the method to be used to provide your acknowledgment/acceptance. Otherwise, your continued use of Digital Banking will serve as your acknowledgment and acceptance of the revised terms.

B. CONSENT TO USE AND SHARE PERSONAL INFORMATION (INCLUDING ACCOUNT INFORMATION)

By accepting this Agreement, you consent to Provident Bank’s disclosure of your personal information (including, but not limited to, "nonpublic personal information" as defined under the Federal Gramm-Leach-Bliley Act and regulations promulgated pursuant to the Act, including but not limited to, 12 C.F.R. § 313.3(n), as amended from time-to-time) including Account information to Provident Bank business partners or other third parties in accordance with Provident Bank’s Customer Privacy Policy which can be found on our website www.Provident.Bank. You understand and acknowledge that this information will be used by Provident Bank business partners or other third parties for the purpose of processing transactions that you authorize by using Digital Banking, as well as for investigations related to transactions that you inquire about and for investigations of alleged or suspected fraud transactions.

Disclosure of Account Information to Third Parties

We may disclose information to third parties about you or your account or your transactions in the following instances:

i. Where it is necessary for completing transactions through Digital Banking or to investigate or resolve a problem related to a transfer or payment;

ii. Where it is necessary for activating additional services;

iii. In order to verify the existence and condition of your account to a third party, such as a credit bureau or Biller/Payee;

iv. In order to comply with a governmental agency or court order, as well as in connection with fraud prevention or an investigation;

v. On a closed account, if we reasonably believe you have mishandled it; or

vi. If you give us your written permission.

C. PRIVACY AND INFORMATION SECURITY

Provident Bank makes security and the protection of your information a top priority. You understand that you can access Provident Bank’s Customer Privacy Statement and Security Information Statement, which are incorporated into and made a part of this Agreement by reference, by visiting www.Provident.Bank, and clicking on the “Privacy” or “Security Center” tabs located at the bottom of the homepage.

Your use of Digital Banking constitutes your express authorization for each transaction processor and/or other third party engaged to complete your authorized transactions to use the e-mail address(es) and telephone number(s) that are associated with you to process and route transactions to and from your Accounts held at Provident Bank. In particular, if you receive notice of a transaction via any e-mail address or via text message at any telephone number, and authorize or accept completion of the transaction, then you are also authorizing all transaction processors and/or other third parties to associate that e-mail address or telephone number with you and with your Account(s).

Accordingly, you agree that we may provide information about you to any other person engaged in processing, facilitating, or delivering transactions to which you are a party. The information we provide may include your name, address, telephone number, and e-mail address. You irrevocably waive any rights granted to you by way of Federal and State privacy laws and regulations that would prevent us from providing this information in connection with any Transaction to which you are a party by use of Digital Banking.

You agree that we may obtain such additional information that we deem reasonably necessary to ensure you are not using Digital Banking in violation of law, including, but not limited to, laws and regulations designed to prevent money laundering or the transfer of funds to or from persons or organizations whose accounts are blocked under regulations of the Office of Foreign Asset Control (OFAC) of the United States Treasury Department or whose access to the United States banking system is prohibited under Federal Regulation GG, Prohibition on Funding of Unlawful Internet Gambling.

You understand that in order to complete your transactions using Digital Banking, it may be necessary for us to communicate with other financial institutions and other third party participants concerning the transactions. You agree that we may use, copy, modify, update, display, and distribute to other persons any information or data you provide to us for the purpose of processing transactions or providing any of the Digital Banking Services, and you give us a license to do so.

You authorize us and any other person engaged in processing, facilitating, or delivering transactions to which you are a party to use information you provide to us, and information concerning your transactions in order to:

i. initiate and complete the transactions, and

ii. provide support to facilitate your use of the Digital Banking Service.

We may also disclose information to third parties about your account or the transactions you authorize and/or conduct, in order to process your transactions or to verify the existence and condition of your Account. These third parties may include but are not limited to transaction processors, clearinghouses, credit bureaus and merchants, as well as other service providers who may participate in the processing of your transactions in the future as technologies evolve and/or security measures are needed to identify or prevent fraud.

Each time you use Digital Banking, you represent and warrant to us that:

i. you have the right to authorize us to access your Account to effect transactions or for any other purpose authorized by this Agreement;

ii. you are not violating any other person’s rights when you provide us information and instruct us to initiate or complete a transaction;

iii. you are not violating any laws or regulations of the United States, any State within the United States, and other Terms and Conditions for use of your Account as disclosed in Deposit Accounts Terms and Conditions Agreement and related disclosures; and

iv. all the information you provide to us is true, current, accurate, and complete.

D. RELATION TO OTHER AGREEMENTS

Your use of Digital Banking may also be affected by the other agreements with Provident Bank for your linked Provident Bank accounts. If you have more than one account with us, you may have the accounts linked together in Digital Banking as we permit.

When you link an account to Digital Banking, you do not change the agreements you already have with Provident Bank for that account. You should review those agreements for any applicable fees, for limitations on the number of transactions you can make, and for other restrictions that might impact your use of an account with Digital Banking.

E. PROVIDENT BANK INTERNET WEBSITE

Your use of Provident Bank’s Internet website is governed by the Website Terms and Conditions, which can be found at www.Provident.Bank. Please read the website terms and conditions carefully, as you agree to be bound by its terms.

F. EQUIPMENT REQUIREMENTS

In order to use Digital Banking, you will need the type of personal computer, tablet, or telephone, as well as any related equipment and software as determined by Provident Bank from time-to-time. In this Agreement, your personal computer, tablet, telephone, mobile device and/or the related equipment are referred to together as your "Equipment".

You are responsible for the installation, maintenance, and operation of your Equipment and your software. Provident Bank is not responsible for any errors, misuse or failures from any malfunction of your Equipment or your software. Provident Bank is not responsible for any personal computer virus, malware, malicious code, other unauthorized alterations of your software, or equipment take over-related problems that may be associated with the use of Digital Banking. Provident Bank shall have no liability to you for any damage or other loss, direct or consequential, which you may suffer or incur by reason of your use of your Equipment or your software.

G. AUTHENTICATION CREDENTIALS

You will be required to use a User ID and Password (collectively referred to as the "Authentication Credentials") to access Provident Bank’s ProvidentConnect Online Banking and Mobile Banking Apps. Use of the Authentication Credentials is the agreed upon security procedure between you and Provident Bank. You may change your Authentication Credentials at any time through the methods determined and permitted by Provident Bank. As an additional authentication measure, you may be required to receive a One Time Passcode (OTP), which provides a further level of confirmation of your identify when you access Digital Banking.

H. SECURITY

Provident Bank is committed to the security of its customers' accounts and account information. Similarly, you must take reasonable precautions to ensure the safety, security, and integrity of your accounts and transactions accessed or conducted via Digital Banking. When you intentionally or unintentionally give someone your Authentication Credentials (including your failure to properly secure your Authentication Credentials), you are authorizing that person(s) to use Digital Banking and you are responsible for all transactions that person(s) performs while using your Authentication Credentials. It is important you recognize and agree that these persons will have complete access to your accounts including monies on deposit and all account information, even if you attempt to limit that person's authority.

I. INDEMNIFICATION

You acknowledge and agree that you are responsible for you and agents conduct while using Digital Banking, and you agree to indemnify and hold Provident Bank and our officers, directors, employees and agents harmless from and against any loss, damage, liability, cost or expense of any kind (including, but not limited to, reasonable attorneys’ fees) that we may incur in connection with a third party claim or otherwise, in relation to: (i) your use of Digital Banking, or (ii) the use of Digital Banking by anyone using your Authentication Credentials, or (iii) your violation of this Agreement, or (iv) the rights of any third party. Your obligations under this provision shall survive termination of this Agreement.

We are not liable for any loss or liability resulting from any failure of our equipment or software, or that of an Internet browser provider by an Internet access provider, or by any online service provider, nor will we be liable for any direct, indirect, special or consequential damages resulting from your access to or failure to access Digital Banking or your accounts.

Virus Protection. Provident Bank is not responsible for any electronic virus or viruses that you may encounter in using or accessing Digital Banking. We suggest that you routinely scan your personal computer, or other Internet-access device, using a virus protection product. An undetected virus may corrupt and destroy your programs, files and your hardware.

J. CHANGES, ALTERATIONS AND AMENDMENTS

This Agreement, applicable fees and service charges may be changed or amended from time-to-time, in our sole discretion, by: (i) sending you written notice by electronic mail or the U.S. Postal Service; (ii) notifying you through Text (SMS) Message Banking; and/or (iii) posting the updated terms on the sites within Digital Banking. Any use of Digital Banking Services after you receive a notice of change will constitute your agreement to such change(s). Please access and review this Agreement regularly and discontinue your use of Digital Banking if you find the Agreement unacceptable to you. From time-to-time, Provident Bank may revise or update the Digital Banking and/or related material, which may render all such prior versions obsolete. Consequently, Provident Bank reserves the right to terminate this Agreement as to all such prior versions of Digital Banking and/or related material and limit access to only the more recent revisions and updates.

K. ADDRESS OR BANKING CHANGES

It is your sole responsibility to ensure that your contact information in your user profile on file with us is current and accurate. This includes, but is not limited to, your name, address, phone number(s) and e-mail address(es). Changes can be made either at any branch location, within the Online Banking application or by contacting Provident Bank’s Customer Contact Center (see “How To Contact Us”).

L. DIGITAL BANKING TERMINATION, CANCELLATION, OR SUSPENSION

Either you or Provident Bank may terminate this Agreement and the Digital Banking services at any time upon giving written notice of the termination to the other party. You may cancel Digital Banking by notifying Provident Bank of your intent to cancel through messaging services available within Digital Banking, or by calling Provident Bank’s Customer Contact Center (see “How To Contact Us”).

Provident Bank may terminate your participation in Digital Banking for any reason, including inactivity, at any time. Provident Bank is not obligated to notify you in advance. If Provident Bank terminates your use of Digital Banking, Provident Bank reserves the right to make no further transfers or payments from your accounts, including any transactions you have previously authorized. Likewise, any additional services you may have used such as Alerts and eStatements will also be terminated.

If you terminate Digital Banking, you authorize Provident Bank to continue making transfers and bill payments you have previously authorized and continue to charge monthly fees until such time as Provident Bank has had a reasonable opportunity to act upon your termination notice. Once Provident Bank has acted upon your termination notice, Provident Bank will make no further transfers or payments from your accounts, including any transfers or payments you have previously authorized. We recommend that you cancel any scheduled payments prior to notifying Provident Bank that you are discontinuing Digital Banking.

Cancellation of Digital Banking only applies to Digital Banking and does not close or terminate your Provident Bank accounts.

M. RIGHT TO TERMINATE ACCESS

In addition to the its other suspension or termination rights listed under these Terms and Conditions, Provident Bank reserves the right to suspend or terminate your use of its Digital Banking if, in Provident Bank’s sole discretion, (i) you violate any of these Terms and Conditions, (ii) you fail to meet any requirement that Provident Bank imposes with regard to either your enrollment information or any required update of your enrollment information, or (iii) you are suspected of conducting, or have conducted, unauthorized or fraudulent transfers using its Digital Banking Service or have conducted transactions that otherwise violate applicable law. Provident Bank reserves the right to terminate or suspend your use of Digital Banking, with or without notice to User.

N. DISCLAIMER OF WARRANTIES

EXCEPT AS OTHERWISE PROVIDED HEREIN, AND SUBJECT TO APPLICABLE LAW, PROVIDENT BANK MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO THE DIGITAL BANKING SERVICE. PROVIDENT BANK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, WITH REGARD TO THE DIGITAL BANKING SERVICES DESCRIBED OR PROVIDED. EXCEPT AS SPECIFICALLY SET FORTH HEREIN OR WHERE THE LAW REQUIRES A DIFFERENT STANDARD, WE SHALL NOT BE RESPONSIBLE FOR ANY LOSS, DAMAGE OR INJURY OR FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, ARISING FROM OR RELATED TO THE EQUIPMENT, BROWSER AND/OR THE INSTALLATION OR MAINTENANCE THEREOF, ACCESS TO OR USE OF DIGITAL BANKING, FAILURE OF ELECTRONIC OR MECHANICAL EQUIPMENT OR COMMUNICATION LINES, TELEPHONE OR OTHER INTERCONNECT PROBLEMS OR INCOMPATIBILITY OF COMPUTER HARDWARE OR SOFTWARE. PROVIDENT BANK DOES NOT WARRANT THAT DIGITAL BANKING SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. THE DIGITAL BANKING SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

Subject to the terms of this Agreement, the Digital Banking Services are generally available 24 hours a day, seven (7) days a week with the exception of outages for maintenance, system enhancements or upgrades and circumstances beyond our control. Live customer service generally will be available each Business Day and on Saturdays, during Normal Business Hours.

O. STOP PAYMENT

Stop payment requests made within ProvidentConnect Online Banking can only be placed on checks drawn on Provident Bank. The Stop Payment is valid for six (6) months from the date the instructions were given by you unless we receive written correspondence from you either correcting or canceling this stop payment order. The preprinted check number is required in order to properly stop the payment. If you do not have a preprinted check number or need further assistance, please call our Customer Contact Center (see “How To Contact Us”).

Stop payment requests cannot be made within ProvidentConnect Online Banking on any type of electronic transaction (including, but not limited to, Provident Bank debit card transactions, automatic debit payments and other ACH payments).

Please call our Customer Contact Center (see “How To Contact Us”) to place a stop payment on items processed through the Provident Bank Bill Pay service on a temporary check. Transactions may be subject to fees and/or transaction scheduling.

The effectiveness of any stop payment order is dependent upon timing between receipt of the stop payment request and receipt of the item for payment. Provident Bank will stop payment on the item within a reasonable period of time from the receipt of this request. A "reasonable period of time" means the item is not presented for payment until the second Business Day following the business day the request is received. Confirmation of the stop payment being placed will be sent to you. Stop Payment requests placed by 10:00 PM ET each Business Day will be processed on the current business day. Stop Payment requests placed after 10:00 PM ET each Business Day or on a non-business day will be processed on the next Business Day.

You understand that your account will be charged a Stop Payment fee as shown in our Service Fee Schedule in effect at the time you made your request for each stop payment request. This fee will automatically be debited from your checking account. Furthermore, you agree to hold Provident Bank harmless for all expenses and costs incurred by us for refusing payment of any check(s), and agree not to hold Provident Bank liable for payment contrary to any stop payment request if same occurs through inadvertence, accident, or oversight. You also understand that any order is subject to your Deposit Account Terms and Conditions Agreement and applicable law.

P. ENFORCEMENT/WAIVER OF JURY TRIAL

You and Provident Bank each irrevocably waive all rights to a trial by jury regarding any claim, dispute or liability arising under or in connection with this Agreement (regardless of whether such claim, dispute or liability is based on breach of contract, tort or other theory of liability, or based on a warranty, or brought at law or in equity). You and the Bank each irrevocably agree that any claim, dispute or liability between or involving you and us, including, but not limited to, any dispute regarding the applicability, validity or enforceability of this "Waiver of Jury Trial; Arbitration" section, shall be resolved by binding arbitration by and under the rules of the American Arbitration Association in effect at the time the claim is filed. You and the Bank acknowledge that this Agreement, including without limitation this section, is governed by the Federal Arbitration Act, which is codified at 9 U.S.C. 9 et seq., in addition to other applicable federal laws and the applicable laws of the state of NEW JERSEY. Judgment upon any arbitration award may be entered in any court having jurisdiction. You and the bank agree that the costs of an arbitration proceeding shall be divided as follows:

The American Arbitration Association filing fee, if any, must be paid by the party that initiates the arbitration proceeding; Each party shall pay their own legal fees, expert witness fees and witness fees, and associated costs; and all other costs and fees shall be paid by the party who must pay the arbitration award, unless the arbitrators decide that it is not fair to do so and otherwise apportion costs and fees between the parties. You and the Bank understand that by agreeing to this "Waiver of Jury Trial; Arbitration" section, you and the Bank are each giving up the right to litigate any claim, dispute or liability in court and before a jury. You and the Bank understand that some of the differences between litigation and arbitration include: discovery, or your ability to request information from the other party, generally is limited in an arbitration proceeding; only individual claims will be arbitrated (class actions and other types of consolidated proceedings cannot be pursued in arbitration); and the ability to appeal, or dispute, the decision or award of the arbitrators generally is very limited. You acknowledge and agree that you have sought, or had the opportunity to seek, such legal advice regarding the provisions in the "Applicable Law" and "Waiver of Jury Trial; Arbitration" sections of this Agreement as you deemed necessary or advisable.

Q. YOUR RESPONSIBILITY

You must have enough available money or credit in any account from which you instruct us to make a payment or transfer, or for you to engage in any other transaction involving the payment or transfer of funds.

You are responsible for all transactions and bill payments you and any person you intentionally or unintentionally permit, who authorizes or makes using any Digital Banking Service, including any transactions or bill payments that you may unintentionally or inadvertently authorize or make, and any losses, charges, or penalties incurred as a result.

R. JOINT ACCOUNTS AND OTHER RELATIONSHIPS

The provisions of this Agreement apply to all Provident Bank Accounts you may own, individually or jointly, as well as other types of Provident Bank Accounts accessed using Digital Banking. When your Digital Banking services are linked to one or more joint accounts, Provident Bank may act on the verbal, written or electronic instructions of any account owner.

S. INFORMATION RECORDING

When you use any Digital Banking Service to conduct transactions, the information and e-mail messages you enter will be recorded. By using Digital Banking, you consent to such recording.

Also, you agree that we may record any telephone conversation you have with Provident Bank regarding Digital Banking and/or your account(s) for the purpose of documenting instructions and/or for training our staff. However, we are not obligated to do so and may choose not to record such conversations in our sole discretion.

T. NO SIGNATURE REQUIRED

When using Digital Banking to pay bills or make transfers, you agree that Provident Bank may debit any Payment Account(s) to pay checks that you have not signed by hand or by legally acceptable form of electronic signature (e.g., digital signature). When using Digital Banking to make transfers from loan accounts, you agree that Provident Bank, without prior notice to you, may take any action required to obtain credit advances on your behalf, including charging your linked loan account at Provident Bank without your handwritten or legally acceptable electronic signature authorization.

U. PROCESSING DAYS

Digital Banking is generally available twenty-four (24) hours a day, seven (7) days a week. However, we only process transactions and update information on Business Days. Any transaction(s), including scheduled payments, to be made on a day that is not a Business Day will be credited, completed, or made on the next Business Day.

V. ASSIGNMENT

You may not assign this Agreement to any other party. Provident Bank may assign its rights and delegate its duties and responsibilities under this Agreement to a company affiliated directly or indirectly with Provident Bank. Provident Bank may also assign or delegate certain of its rights and responsibilities under this Agreement to independent contractors or third parties.

W. GOVERNING LAW; JURISDICTION

Regardless of where you live or work or where you access Digital Banking, this Agreement will be governed by, and construed in accordance with, the laws and regulations of the State of New Jersey and the Federal laws of the United States of America, as and where applicable.

In the event either party brings legal action to enforce this Agreement or collect overdrawn funds on accounts accessed under this Agreement, the prevailing party shall be entitled, subject to applicable law, to payment by the other party of its reasonable attorney's fees and costs, including fees on any appeal, bankruptcy proceedings, and any post-judgment collection actions, if applicable. If there is a lawsuit, you agree that it shall be filed and heard in the State of New Jersey.

X. NO WAIVER

Provident Bank shall not be deemed to have waived any of its rights or remedies unless such waiver is in writing and signed by Provident Bank. No delay or omission on the part of Provident Bank in exercising its rights or remedies shall operate as a waiver of such rights or remedies or any other rights or remedies. A waiver on any one occasion shall not be construed as a bar or waiver of any rights or remedies on future occasions.

Y. SEVERABILITY

Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law as nearly as possible to reflect the original intent of this Agreement, and the remaining portions shall remain in full force and effect.

We must hear from you no later than sixty (60) days after we sent the FIRST statement on which the problem or error appeared. Provident Bank may not immediately receive e-mail that you send. We will not take actions based on your e-mail requests until Provident Bank actually receives your message and has a reasonable opportunity to act. When contacting us, please:

i. Tell us your name and account number (if any);

ii. Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information; and

iii. Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days. We will determine whether an error occurred within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty five (45) days to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not credit your account.

For errors involving new accounts, point-of-sale, or foreign-initiated transactions, we may take up to ninety (90) days to investigate your complaint or question. For new accounts, we may take up to twenty (20) business days to credit your account for the amount you think is in error.

We will tell you the results within three (3) business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
