ADDENDUM III:
TEXT (SMS) MESSAGE BANKING
Text (SMS) Message Banking Service (“Service”) requires an initial registration process within ProvidentConnect Online Banking. You agree that your usage of our Text (SMS) Message Banking is conditioned on you providing us with a valid U.S. mobile phone number and indicates your agreement to our sending you text messages through your wireless provider.
Sending Messages
We may send any Text (SMS) Message through your wireless provider in order to deliver it to you. You agree that your wireless provider is acting as your agent in this capacity.
We will send you a message only once and only with your explicit agreement.
Mobile Phone Number
You agree to provide a valid U.S. mobile phone number for this Service so that we may send you certain information about your applicable account(s). We will determine in our sole discretion what information we make available through this Service.
You agree to indemnify, defend and hold us harmless from and against any and all claims, losses, liability, cost and expenses (including reasonable attorneys' fees) arising from your provision of a mobile phone number that is not your own or your violation of applicable Federal, State or local law, regulation or ordinance. Your obligation under this paragraph shall survive termination of the Agreement.
Account Statements
Provident Bank Text (SMS) Message Banking is provided for your convenience and does not replace your monthly account statement(s), which is the official record of your account(s). This Service may not be encrypted and at some point, may include personal or confidential information about you, such as your account activity or status. You agree to protect your communications device that receives information through this Service and not to let any unauthorized person have access to the information we provide to you through this Service.
Marketing
We will not send you marketing messages through the Text (SMS) Message Banking Service.
Liabilities
Receipt of account information through the Service may be delayed or impacted by factor(s) pertaining to your wireless provider or other parties. We will not be liable for losses or damages caused in whole or in part by your actions or omissions that result in any disclosure of account information to third parties. Also, nothing about the Service creates any new or different liability for us beyond what is already applicable under your existing account agreements.
Fees
There is no separate fee for this Service, but you are responsible for any and all charges including, but not limited to, fees otherwise applicable to your account(s) and fees associated with text messaging imposed by your wireless provider. Message frequency depends on user preferences. Provident Bank does not charge for any content; however, downloadable content may incur additional charges from your Wireless Provider. Contact your Wireless Provider for information about your messaging plan. Your Wireless Provider may impose message or charge limitations on your account that are outside of our control. All charges are billed by and payable to your Wireless Carrier.
Your Representation
You represent that you are the owner of the wireless device you use to receive the Service, and that you are authorized to approve the applicable charges.
Use Of Information Provided
Data obtained from you in connection with this Service may include your mobile phone number, your Wireless Provider’s name, and the date, time, and content of your messages and other information that you may provide. We may use this information to contact you and to provide the Services features you request from us, and to otherwise operate, develop, and improve the Service. Your Wireless Provider and other service providers may also collect data from your SMS usage, and their practices are governed by their own policies. We will only use the information you provide to the Service to transmit your text message or as otherwise described in this Agreement.
Proprietary Service
The Service, as well as the content and materials received through the Service are proprietary to us and our licensors, and are for your personal, non-commercial use only. You shall not damage, impair, interfere with, or disrupt the Service or its functionality.
Geographical Limitation
The Service is available only in the United States.
Assistance With The Service
If you have any questions, please use the contact information in the “How To Contact Us” section of this Agreement for assistance. You can also text the word HELP to 454545 to get additional information about the Service. If you receive a message from us unexpectedly, you can text the word STOP to 454545. We do not charge for help or info messages; however, your normal wireless provider rates apply.
